Defensive Asylum Proceedings

If you are already in removal proceedings, you can still file Form I-589 for asylum. This is known as the defensive asylum process, and it works differently from the affirmative process. In a defensive case, your application will be heard by an immigration judge rather than a USCIS officer.


During the hearing, the judge will consider your testimony, review your evidence, and may also hear from any witnesses you bring.
